TERMS AND CONDITIONS
Please read the following carefully and check “I agree to the terms and conditions” when you are ready to proceed.
Liability Waiver: I acknowledge and affirm that I am competent to decide whether or not to participate in yoga/meditation and/or mindfulness classes, health and wellness programs or workshops offered by Enliven Resources LLC dba Enliven Health & Wellness and the respected provider of each class/program. I will make an informed choice before doing so. I hereby agree to the following:
1. I understand that there are inherent risks involved in the Programs, including the risk of serious physical injury and more. I fully assume all risks associated with the programs, including: intensive physical activity and exertion, causation or aggravation of a physical injury or medical condition, lack of warnings or inadequate warnings: lack of instructions, inadequate instructions, or my failure to follow instructions: slipping from slippery surfaces such as mats or floors; equipment failure; and the like. I am fully aware of and accept the risks and hazards involved, and agree to assume full responsibility for any risks, conditions, injuries or damages, known or unknown, which I might incur or aggravate as a result of my participation in the programs.
2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Yoga/Meditation and/or Mindfulness classes, Health Programs or Workshops, and to receive prior approval to participate. I represent and warrant that I am physically fit and I have no medical condition or injury, which would prevent my full participation in the Yoga/Meditation and/or Mindfulness classes.
3. I, for myself and my heirs, assigns, successors, executors, administrators, and legal representatives hereby release and agree that I will not sue Enliven Resources, LLC dba Enliven Health & Wellness., its Affiliates, Officers, Directors, Agents, Servants, and Employees or the landlord of any premises at which it may operate, for money damages for personal injury or property damage sustained by me during my use of presence in, and/or participation in the Enliven Resources, LLC dba Enliven Health & Wellness. facilities, equipment and Programs.
4. I, for myself and my heirs, assigns, successors, executors, administrators, and legal representatives hereby agree I will defend, indemnify and hold harmless Enliven Resources, LLC dba Enliven Health & Wellness, its Affiliates, Officers, Directors, Agents, Servants and Employees or the landlord of any premises at which it may operate, from any and all claims, suits or demands by anyone arising from my use of, presence in, and/or participation in the Enliven Resources, LLC dba Enliven Health & Wellness facilities, equipment and Programs.
5. I understand that it is my continuing responsibility to inform the instructor(s) at Enliven Resources, LLC dba Enliven Health & Wellness, of any previous medical conditions, injuries or surgeries prior to my first class and at such other times as I acquire information as to same.
6. I also understand that, except for monetary refund, I have no claim against Enliven Resources, LLC dba Enliven Health & Wellness or the landlord of the premises (except for the monetary refund) by reason of their refusal to allow me to participate in the Programs. I have read the above Release and Waiver of Liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above.
Cancellation Policy: I understand and agree to Enliven Resources, LLC dba Enliven Health & Wellness’s late-cancel and no-show policy and understand the fees involved. I must cancel my class more than 12 hours prior to the class start time in order to unreserve my spot and return it to my account. If I cancel my class 12 hours or less prior to the class start time, this will be considered a “late-cancel.” If I do not show up to my class and do not cancel, this will be considered a “no-show.” I understand that Enliven Resources, LLC dba Enliven Health & Wellness will automatically charge any late-cancel or no-show fees to my credit card on file.
A) Unlimited Memberships and Unlimited Packages
i. Late-cancel is a $10 fee. No-show is a $20 fee.
B) Single Classes, Class Packages and New Client Specials.
i. Late-cancel is a $10 fee. No-show results in loss of class credit
